Mental health legislation and policy
- Review of mental health law
The Scottish Government are conducting a limited review of the Mental Health (Care & Treatment) Scotland Act 2003. The terms of the review are available from the Scottish Government website. We asked the Government to consider a number of amendments based on our experience of monitoring the law click here to view our response.
- Flu pandemic and civil emergency responses
The Scottish Government consulted on proposed amendments to mental health law in the event of a flue pandemic or other civil emergency. We made several recommendations to safeguard the rights of people with a mental disorder. Click here to view our response
Adults with incapacity legislation & policy
The Scottish Law Commission has called for submissions in relation to its eight programme of law reform. Based on our experience of the operation of the Adults with Incapacity Act 2000 we have made a number of suggestions for legislative amendment
