If you need information or advice about your rights in relation to mental health care and treatment, or you are concerned about the rights and welfare of someone else, we can help. As well as providing information and advice, we may be able  to help put things right.

We provide advice and information about rights and best practice in relation to two laws:

  • the Mental Health (Care & Treatment) (Scotland) Act 2003
  • the Adults with Incapacity Act 2000

How making a call helped Brian

Brian was admitted to hospital for treatment for a mental illness. His advocate called us for advice when the Benefits Agency told Brian he owed them hundreds of pounds. They said he had received too much money while he was in hospital. The hospital had been responsible for Brian's money while he was a patient. The advocate thought it wasn't fair that Brian was being asked to pay the money back. He had tried to sort things out with the hospital but 'wasn't getting anywhere'. We wrote to the Health Board responsible for the hospital and asked them to look into the problem. The Health Board checked the situation and said the hospital should pay the money back. The hospital settled the debt in full and apologised to Brian for any distress that had been caused.
